Immigration,Citizenship & visas

My office can assist constituents with various issues concerning immigration and citizenship. The federal agencies that oversee immigration processes include United States Citizenship and Immigration Services (USCIS) and other offices within the Department of Homeland Security (DHS) and the Department of State (DOS), including U.S. Immigration and Customs Enforcement (ICE), the National Visa Center (NVC), U.S. Embassies and Consulates, and the Executive Office for Immigration Review (EOIR, Immigration Court).

Visas

The U.S. Department of State (DOS) is responsible for issuing immigrant and nonimmigrant visas, operating the National Visa Center (NVC), and managing U.S. embassies and consulates abroad, as well as facilitating many aspects of international travel and U.S. foreign policy. Common constituent concerns related to DOS include pending immigrant and nonimmigrant visa applications, case status updates, application delays, and requests for expedited processing. In certain circumstances, my office may be able to assist constituents experiencing issues with visa applications or other DOS-related matters by submitting formal congressional inquiries and requesting updates from the agency.

Common Areas of Assistance

U.S. Citizenship and Immigration Services (USCIS)

  • Case Status Request for Cases Outside of Estimated Processing Time: If your case is pending longer than USCIS's estimated processing time for your petition type, my office can contact the agency to receive an update on the status of your application.
  • Expedite Requests (USCIS): My office may submit expedite requests to USCIS on behalf of applicants, if an applicant believes they meet one or more of the agency's posted expedite criteria. When reaching out, please communicate what criteria you fall under and why. For these requests, my office is required to provide a written statement, documents of evidence, and a signed Privacy Act Release Form. Please note that while my office may submit an expedite request, I cannot guarantee that USCIS will approve the request. For more information on USCIS's expedite criteria, please click here.
  • Clerical or Filing Errors: My office can assist with correcting errors such as incorrect information on a Notice of Action, unsuccessful address updates, or mistakes on issued immigration documents (e.g., incorrect visa category or spelling errors).

U.S. Department of State (DOS)

  • Immigrant and Nonimmigrant Visa Applications: My office may request status updates and additional information regarding immigrant and nonimmigrant visa applications processed at the National Visa Center or U.S. Embassies and Consulates abroad, including family-based, employment-based, student, exchange visitor, and tourist visas.
  • National Visa Center Concerns: My office can submit inquiries related to cases pending with the National Visa Center, including status updates for documentarily complete cases, interview scheduling delays, and requests for clarification regarding required documentation.
  • U.S. Citizen Services Abroad: My office can request information related to U.S. citizen services abroad, including Consular Reports of Birth Abroad (CRBA) and in certain emergency situations involving U.S. citizens and their loved ones.
  • Expedite Requests: My office can submit requests for expedited processing to the State Department if a constituent's circumstances meets the agency's guidance for emergency expedited processing. The State Department considers congressional requests for expedited processing when a case involves a true emergency such as an urgent medical need, if you believe an error has occurred in the processing of your case, or if you have another qualifying emergency situation. Supporting documentation is required for all expedite request submissions. Supporting documentation must be submitted in English or be accompanied by a translated English copy. All final adjudication decisions are made by the agency.

U.S. Immigration and Customs Enforcement (ICE)

  • Help for Detained Individuals and their Families: My office may be able to assist constituents with certain matters involving the U.S. Immigration and Customs Enforcement (ICE). With a signed ICE-specific Privacy Act Release Form, my office can submit congressional inquiries to ICE to request information or clarification on a case, including case status updates or concerns related to detention or enforcement actions. For individuals who are detained, our office may also help locate someone currently in ICE custody by using the Online Detainee Locator System, and communicate with ICE to seek general information about their situation. My office can serve as a point of contact to request information, raise concerns, and help constituents receive responses from the agency.

Limitations to Assistance

My office will do everything possible to assist constituents within the legal and practical limitations of a congressional office. Please note that a congressional inquiry does not guarantee faster processing or a favorable outcome. If my office reviews your concern and determines that it falls outside the scope of congressional assistance, my office will do our best to direct you to the appropriate resource for further help.

  • Priority Date: Each month, the Department of State releases updates to the Visa Bulletin. If the visa category under which you have filed is numerically limited, you may need to wait for further processing if your priority date is not shown as 'current'. If your priority date is not shown as 'current', unfortunately, my office is not permitted to assist as priority dates cannot be expedited.
  • Background Checks: My office cannot influence or expedite required security vetting, administrative processing, or background checks.
  • Denials/Appeals: Once a petition/application has been denied by USCIS or another federal agency, my office cannot request a reversal of that decision. If the appeals process has been finalized by the agency, you may follow the agency's instructions on how to submit a formal appeal. While my office cannot submit an appeal for you, we can request an update from the agency if you have submitted an appeal and have not received a response.
  • Legal Advice or Representation: If you are seeking legal assistance, representation in court, assistance filing an application, or need help making the next decision in your immigration process, please seek out professional legal assistance from an accredited immigration attorney. Please be aware of fraudulent actors that may pose as lawyers. If you are looking for information on how to avoid fraudulent filers, please review the USCIS Find Legal Services page or the American Immigration Lawyers Association with information on how to determine if someone is qualified to represent you in your immigration process.
