Warren, Murray, Booker, Pressley, Garcia, Colleagues Will Reintroduce COVID-19 in Corrections Data Transparency Act
Lawmakers urge leadership to include portions of Federal Correctional Facilities COVID-19 Response Act and COVID-19 in Corrections Data Transparency Act in the upcoming COVID-19 relief package
Washington, D.C. -- United States Senators Elizabeth Warren (D-Mass.), Senators Patty Murray (D-Wash.) and Cory Booker (D-N.J.), along with Congresswoman Ayanna Pressley (D-Mass.) and Congresswoman Sylvia Garcia (D-Texas) will reintroduce of the COVID-19 in Corrections Data Transparency Act, bicameral legislation that would require the Federal Bureau of Prisons (BOP), the United States Marshals Service (USMS), and state governments to collect and publicly report detailed data about COVID-19 cases, hospitalizations, deaths, and vaccinations in federal, state, and local correctional facilities.
The COVID-19 in Corrections Data Transparency Act, which was originally introduced in August 2020, is co-sponsored by Senators Edward J. Markey (D-Mass.), Richard Blumenthal (D-Conn.), Tammy Baldwin (D-Wisc.), Bob Casey (D-Penn.), Ron Wyden (D-Ore.), Chris Van Hollen (D-Md.), Jeff Merkley (D-Ore), Sherrod Brown (D-Ohio), Mazie Hirono (D-Hawai'i) and Tammy Duckworth (D-Ill.) and Representatives David Trone (D-Md.), Val Demings (D-Fla.), and Jahana Hayes (D-Conn.).
Although prisons and jails have become hotspots for the rapid spread of COVID-19, there is a troubling lack of comprehensive and publicly-available data from the BOP, the USMS, and state and local governments about the spread and management of COVID-19 in correctional facilities.
At the federal level, the BOP posts daily COVID-19 updates on its website but excludes important information, such as hospitalization numbers, and does not disaggregate data based on demographic categories. The USMS provides even less data on its website on COVID-19 cases for individuals in its custody. At the state and local level, many state-run jails are not publicly reporting any information about COVID-19 cases, aside from a small number of large facilities. Even amongst the facilities that are reporting some information, however, the data are not standardized, and no central authority is ensuring that the data are easily accessible to and digestible by policymakers, public health experts, criminal justice professionals, and the public. This lack of detailed and public data is making it harder to manage the pandemic and address outbreaks in real time, and contributes to the rampant spread of the virus both inside correctional facilities across the country and in the communities in which they are situated. This places incarcerated individuals, correctional staff, and the public at risk.
Senators Warren, Booker and Baldwin along with Representatives Pressley, Nannette Diaz Barragán (D-Calif.), and Tony Cárdenas (D-Calif.) sent a letter urging Senate and House leadership to include provisions that would fund routine diagnostic testing, contact tracing, vaccine distribution, and data collection in federal, state, and local correctional facilities in the upcoming COVID-19 relief package. The lawmakers specifically ask Senate and House leadership to include portions of Federal Correctional Facilities COVID-19 Response Act and COVID-19 in Corrections Data Transparency Act in the upcoming COVID-19 relief package.
"As a result of their confinement, incarcerated people are at increased risk of contracting COVID-19, and reports show that COVID-19 has spread like wildfire in correctional facilities across the country. This bill takes a necessary step towards containing the pandemic and supporting the health and safety of incarcerated individuals, correctional staff, and the general public by strengthening data collection, reporting, and transparency," Senator Warren said.
"As we've feared since the onset of this pandemic, our nation's prisons, jails, and detention facilities have proven to be among the worst hotspots for COVID-19," said Congresswoman Pressley. "The most effective way to stop the spread of COVID-19 in these facilities is to prioritize decarceration. We must use every tool at our disposal to save lives and protect the health of our most vulnerable behind the wall. By mandating the collection and reporting of standardized, disaggregated data on COVID-19 cases, testing, and vaccinations in prisons, jails, and detention facilities nationwide will make plain the extent of this crisis and incite action to save lives. This is a matter of life and death, and we must act with the necessary urgency to stop the spread of this virus, protect the public health, and save lives."
"We need to be taking the necessary precautions to beat COVID-19 everywhere, including in correctional facilities, where incarcerated people have too often been exposed to this deadly disease because of lax health and safety measures," Senator Murray said. "This legislation is an important step we should take towards better understanding and addressing the impact of COVID-19 in correctional facilities."
"Contracting COVID-19 in prison can be tantamount to a death sentence," said Senator Booker. "People in prison and jail tend to have much higher rates of underlying health issues than the general public, and the conditions of confinement make social distancing virtually impossible, and as a result people in prison and jail are disproportionately contracting and dying of COVID-19. To track and stop the spread of this virus and save lives, we need accurate, up to date, detailed data that reflects the reality of the crisis we are facing."
"A prison sentence shouldn't be a death sentence, and we know that COVID-19 is killing far too many incarcerated individuals," said Senator Markey. "This legislation shines a spotlight on the problem of coronavirus in correctional facilities, helps to identify the data we need to understand the problem, and leads to the implementation of best practices to combat it."
"Nearly a year after lockdowns started to be implemented across America to try and keep folks safe from the coronavirus, we're still struggling to contain the spread. No place is this more true than in our nation's prison system where incarcerated people are at high risk of infection," Senator Wyden said. "Congress must push to meet this crisis with the strictest commitment to the health and safety of everyone, whether incarcerated or not. In order to do so, public health experts and policymakers must have access to the most comprehensive data to get an accurate picture of what's happening to incarcerated people and correctional staff in federal prisons across the nation."

It's horrifying that when our correctional facilities become hotbeds of the coronavirus, any sentence can quickly turn into a deadly punishment," said Senator Merkley. "Collecting and publicly reporting data about the spread of the coronavirus in these facilities is an important step in our fight to ensure that we protect the lives and health of those in our custody."
"For too long, federal, state and local corrections facilities were left to address this crisis on their own, leaving many without any guidance or support," said Senator Brown. "We know a systemic problem has contributed to the rampant spread of COVID-19 in these facilities, but in order to stop the spread, we need a clear picture of what's happening. This legislation will help ensure we have the accurate and reliable data needed to put an effective plan in place, and work to protect everyone in these facilities."
The COVID-19 in Corrections Data Transparency Act would provide public health experts, policymakers, and the public with critical information about COVID-19 in correctional facilities. The bill does this by:
- requiring BOP, USMS, and state and local correctional facilities to submit the following data to the CDC on a weekly basis, and regularly publish on their websites:
- the numbers of incarcerated individuals and correctional staff who have been tested for COVID-19, and the type of tests performed,
- the results of COVID-19 tests, including the numbers of confirmed negative tests, confirmed active cases, pending tests, and the average time to obtain test results,
- the outcomes of COVID-19 cases, including the numbers of people who were hospitalized, recovered, placed in or released from quarantine or medical isolation, or died from COVID-19,
- the term of imprisonment and time served for incarcerated individuals who have been infected with COVID-19;
- the numbers of incarcerated individuals and correctional staff who have been given a first does of a vaccine, have declined a vaccination, and are fully vaccinated;
- mandating that the data collected and reported be disaggregated by sex, sexual orientation, gender identity, age, race, ethnicity, disability, and geography; and
- subjecting states that fail to submit the required data to the CDC to a penalty in the form of a 10% reduction in future Byrne JAG grant funding.

Since the start of the COVID-19 pandemic, Senator Warren has pressed for action and legislation to mitigate the rampant spread of COVID-19 throughout correctional facilities. This includes introducing legislation to require weekly testing and data collection standards in federal prisons, requesting information on prisoner transportation services, inquiring about COVID-19 response plans to protect both inmates and correctional staff, and urging reevaluation of harmful practices that increase the risk of outbreaks amongst prison populations.
